With this Privacy Notice, we aim to provide clear, detailed and easy-to-read information about how we use the personal information you provide to us and how we generally process personal information.

First, we provide an outline of our Privacy Notice so that you can easily navigate to the sections you are most interested in.

goadgo Privacy Statement

First things first: definitions

First and foremost, if there are capitalized or defined terms in this Privacy Notice that are not defined here, those terms will be the same definition used in goadgo's other agreements. If you have a different agreement with us, such as an Influencer Membership Agreement, we will use the definitions from that agreement. When we talk about our Services, we mean our Services as defined herein. This Privacy Notice applies to our processing of personal information on our Services.

When we use the term 'personal information' in this Privacy Notice, we are referring to a wide range of information. Data protection laws around the world define this term in different ways, but generally we mean information relating to an identifiable, living person or their household. It does not include aggregated or de-identified data held in a form that cannot reasonably be associated with or linked to you. If we use de-identified data, we will keep it in de-identified form and will not attempt to re-identify it. For example, your username on goadgo is personal information, but a Brand's company name and store information is not personal information because it does not relate to an individual person.

Throughout this Privacy Statement, we will talk about our Influencers. Our Influencers are individuals and organizations with social media presences, agents or agencies, digital publishers and other content platforms that use our Services to share content or links.

Brands are vendors who sell products in collaboration with our Influencers. Our relationship with Brands is slightly different because Brands do not provide us with personal information.

goadgo is responsible for making decisions about how to process the personal information we collect. This makes us the controller (or equivalent) of the data we process.

The personal information we collect depends on how you interact with us and the services we provide to you. Because the information we collect will vary significantly depending on your relationship with us, we will treat our collection in terms of that relationship.

Personal Information of Influencers

Influencers have a more complex relationship with goadgo. As an Influencer, you expect us to provide a service that includes link tracking, paying you commissions when Shoppers buy related products you recommend, and providing an online store where you can connect with Brands and publish personal information about yourself. To provide this service, we need to process your personal information.

How do we collect and use influencers' personal information?

Due to the highly specialized service we provide to our Influencers, we collect and use much more personal information from our Influencers.

Application information. When you apply to become an Influencer at goadgo we need to collect some personal information about you. Some of this is contact and account information, including your full name and email address. We also collect your phone number to provide support and response, security and account verification. We also collect your profiles in other online media so that we can assess your suitability for goadgo.

Contact and account information. We also collect a great deal of impressive account information. We will get your full name, email address, phone number and general location because we need to contact you and pay you.

Sensitive information. When you create a goadgo Influencer profile you can choose to share demographic information, including your race or ethnicity, gender and even your style or body type. You can also share your interests and specialties and your general location. These fields are optional. Some sensitive information may be required for identity verification purposes, such as government ID. If we ask you to share a proof of identity, we will use it only for identity verification and for no other purpose.

Payment, collaboration and marketing campaign information. As you use your account, we will see your goadgo account balances, agency contact information (if applicable) and your payment and commission history. Our payment processors process payments on our behalf; we do not accept or process payments directly through our Services, and we will not see or collect your credit card or banking information.

Content such as photos and videos. As an Influencer you can upload content in various media to your goadgo Shop, including photos, videos, recordings and audio. This may include images or other marks of you or others. You may only upload content belonging to others if you have the right to do so (i.e. you have obtained all necessary permissions and consents). With your permission, we may also access your camera roll or saved images, such as screenshots from products on our Services.

Information we collect from third parties

Contacts, Shoppers and referrals. When a person chooses to invite you to join goadgo, refers you to our Services or shares an image with you via email or text message, we may receive your information from that person. We also collect your information from Customers who interact with your content on other social media sites through goadgo Links so that we can track sales and facilitate commissions.

Business partners. We may receive your information from our business partners who provide our Services through a co-branded or private labeled website or from companies that offer products or services on our Services.

Service providers. Service providers who perform services on our behalf, such as survey and marketing providers, may collect personal information and often share some or all of that information with us. We may also occasionally receive information from third party information providers. These information providers may correct or supplement the personal information we collect, such as helping us obtain updated contact information to reconnect with an Influencer. They may also provide contact information for people who may be interested in using our Services. If goadgo has contacted you, we will be happy to share information about the third-party service provider who shared your information with us.

Social media sites. When you connect to or interact with goadgo through various social media sites, we may receive certain information about you that you allow the social media site to share with us. This information may include name, gender, date of birth, geographic location and interests. We also collect data such as traffic, impressions, views, clicks and similar information when you interact with and use goadgo through other social media. The data we receive depends on your privacy settings on the social media site. You should always review and, if necessary, change your privacy settings before sharing information on, linking to, or connecting with third-party websites, apps, and social media services.

Publicly Available Sources. We collect personal information about individuals from public sources, such as contact information, employment-related information, and information about interests in services, which we do not otherwise have, We may combine this information with information we collect directly from an individual. We use this information to communicate with individuals, send advertising or promotional materials, personalize our Services, and better understand the demographic characteristics of the individuals with whom we interact.

How do we share influencers' personal information with others?

We share the above categories of personal information with third parties in the following scenarios:

Brand Partners, Affiliate Networks: When a Shopper clicks on a goadgo shopping link on a third-party social media site of goadgo, the link takes them to one of our third-party Brands to get more information about the product. Generally, the Shopper's information will pass through one of our affiliate networks before reaching the Brand. This link contains a number to help us identify you as an Influencer so that we can pay you your commission on the sale if they make a valid purchase through a link you recommend.

We also share your personal information with Brands in other ways. When you choose to feature a Brand's products on your goadgo Shop or use a goadgo link on your external social media site, the Brand will see your referral. In some cases, Brands receive information about the Creators who referred their products, such as a list of top referrers.

Creators and API Developers. We may provide information about you to third-party sites, networks, platforms or applications and third-party applications that interface with goadgo application programming interfaces. We share anonymized geolocation data, items purchased and sales amount with our Brands and Influencers. We may combine information from different Services internally to provide better and more customized services. We contract with companies that help with parts of our operations and improve our Services.

Creators' own disclosure and privacy obligations

As a Creator, you have some privacy obligations of your own.

When you start using goadgo links, scripts and other technologies that we make available on your own website or social media site, we will collect and store information about you and your readers. It is your responsibility to ensure that your own website or social media site complies with applicable laws regarding the collection and use of personal information and consumer data.

Data protection considerations for brands

Brands do not provide their users' personal information to goadgo.

Instead, Brands typically receive personal information of Influencers when working with goadgo. A Brand receives an Influencer's personal information in several ways. First, in some cases, when a Shopper clicks on a goadgo link and purchases a product from the Brand, the Brand may receive the Influencer's personal information in the form of a unique identifier. This identifier informs the Brand that a product was purchased through an Influencer's recommendation and allows goadgo to pay a commission to the Influencer. Brands are responsible for ensuring adequate privacy protections regarding the personal information of Influencers. We provide an additional agreement to our Brands and these terms will control our relationship. Please refer to that agreement. If you are a representative of a Brand, you will have an account that will allow you to log into our Brand Portal.

Making choices about your personal information

Your account information. You have rights regarding your personal information, including the right to access the information we have about you, to correct inaccurate information, to download a copy of your data, to restrict the use of your data and to delete your data. We offer you many options to access, correct, control or delete your personal information in your account settings. If you are a creator, you can delete or change any of the optional data settings from where you added it. If you are unable to access or change any part of your account and would like to do so, please contact us and we will assist you. Please note that there may be data items that we cannot change or delete for security or legal reasons.

If you have linked your account to a third-party service such as Facebook, Google or Apple, you can change your settings and unlink from that service in your account settings.

It is your responsibility to keep your personal information up to date.

Communication. We use your email and, if you have given us permission, your phone number or third-party app ID to contact you. For example, if you have told us you are interested in becoming an Influencer, we will contact you about this process. If you are interested in our events, we will send you information about events in your area.

Unless you deactivate your account, you cannot opt out of service emails from us, such as password reset emails or notifications of updates to our terms.

We may also send push or local notifications to your device to provide updates and related messages. You will be able to manage notifications through your account settings in the App or through your device.

Your account is being closed. You can close your account at any time by using the deletion process in your account settings in the app or by contacting our Customer Support team. When you delete your account, you lose access to the account and all content within it. We will need to resolve any outstanding unpaid commissions before we can close your influencer account.

Data retention. We retain personal information for as long as necessary to provide the Services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements and fulfill other legitimate and lawful business purposes. Since these needs may vary depending on different types of data within different service contexts, the actual retention periods can significantly differ based on criteria such as user expectations or consent, data sensitivity, and the availability of automated controls to facilitate data deletion within a certain timeframe. We adhere to your account settings and legal or contractual obligations. For example, most of your deletion requests will be processed immediately, such as deleting certain data items in your account, but we will retain security logs for a longer period of time.

However, if you have closed your account and addressed unresolved concerns by blocking legal or reporting requirements, we will delete your entire profile within 30 days of your request. During this 30-day period, we will continue to protect and use your information as described in this Privacy Notice.

After we close your account, we may retain some data associated with your account for legal or security purposes, such as records of commissions we have paid you.

Cookies and tracking technologies

goadgo uses common information collection tools such as cookies, web beacons, pixels and other similar tracking technologies to automatically collect information when you browse our app, website, account or interact with emails we send you.

Security information

We implement appropriate technical and organizational measures to protect your personal information against accidental or unlawful destruction, loss, alteration or damage. These measures vary depending on the sensitivity of the personal information we collect, process and store and the current state of technology. We also take measures to ensure that service providers who process personal information on our behalf have appropriate security controls in place.

To help us protect your account, we ask that you use a strong password and never share your password with anyone or use the same password on other sites or accounts. For security purposes, we recommend that you keep your phone, computer or any device you use to access goadgo updated to the latest version. Please note that we will never contact you unexpectedly by phone or email requesting your account ID, password, credit or debit card details or national identification numbers.

Global privacy compliance and international transfers

goadgo is proud to be a global company with Influencers and Brands worldwide. Therefore, our approach to privacy compliance is global. At goadgo, we are committed to complying with applicable data protection laws and protecting your data.

Regions that require a legal basis for processing personal data

If you are from a territory that requires a legal basis for processing personal information (such as the EEA or the United Kingdom), our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which that information is collected by us. However, we will normally only collect personal information from you where we need the personal information to perform a contract with you or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms, or where we obtain your consent to do so. In some cases, we may also have a legal obligation to collect personal information from you, or we may otherwise need the personal information to protect your vital interests or those of another person, as in the case where we request personal information from you in this context as a result of a government audit or in response to a request from law enforcement. Generally speaking, when we use personal information to further our legitimate interests, this is for limited purposes:

  • Understanding who our influencers are and what their interests are;
  • Managing our relationships with our Influencers and Brand representatives, providing support and product enhancements;
  • Responding to questions, concerns, and complaints, and communicating with you when you have an issue;
  • Conducting core business operations such as accounting, tax filing and fulfillment of regulatory obligations; and
  • Detecting, preventing, or investigating security incidents, fraud, financial crimes, and other abuse or misuse of our Services.

Cross-border data transfers and onward transfers

goadgo is headquartered in the United States and we process personal information in the United States. We also use service providers all over the world. We may therefore transfer, store and process your personal information outside of your jurisdiction of residence. When we transfer your personal information, we maintain the same standard of data protection regardless of where the information originates and where it is processed.

When we transfer personal information from the EEA, the United Kingdom or Switzerland, we expect to rely on the EU-US Data Privacy Framework. To the extent that the transfer of personal information is not covered by the Data Privacy Framework, we rely on other data transfer mechanisms such as Standard Contractual Clauses and the International Data Transfer Agreement. You can obtain a copy of the Standard Contractual Clauses or the International Data Transfer Agreement by contacting us.

When we transfer personal information from countries outside the EEA, the United Kingdom or Switzerland, we endeavor to comply with the data protection and data transfer laws of those countries by cooperating or entering into a written agreement with the data protection authority of that country.

Privacy Compliance for Specific Individuals

Personal information of the job applicant and candidate. If you are applying for a position at goadgo or are a candidate for a job here, our Candidate Privacy Notice provides up-to-date information about the personal information we collect about you and how we protect it.

Information from children. We do not knowingly allow children under 16 to create an account on goadgo and we do not direct our Services to children. If we determine that someone under 16 has registered for a goadgo account, we will take reasonable steps to promptly remove that person's personal information from our records. If you are a parent or guardian and believe that a child has registered for a goadgo account, please contact us to request that we remove that personal information. If we have actual knowledge that we have received personal information from a child, we will immediately delete that information from our records.

State-specific Privacy Information

If you are a U.S. resident, we process your personal information in accordance with applicable U.S. state data privacy laws, including the California Consumer Privacy Act (CCPA), Colorado Privacy Act (CPA), Utah Consumer Privacy Act (UCPA) and Virginia Consumer Data Protection Act (VCDPA). We do not discriminate or alter our practices based on where you live; all of our Shoppers and Consumers have the same rights, and exercising your rights will not change how we provide our Services. However, if you request us to delete or restrict your personal information, this will affect your ability to use goadgo, especially if you are an Influencer. We will provide you with the ability to (i) receive detailed information about the categories of personal information we collect, use, disclose, share, and sell; (ii) access and obtain a copy of the personal information we hold about you; (iii) correct any inaccurate personal information we hold about you; (iv) limit the use and disclosure of your sensitive information; (v) delete your personal information; and (vi) opt-out of the sharing of your personal information for future targeted advertising purposes. You can make these requests yourself or through an authorized agent. If you use an authorized representative, we will provide detailed guidance to your representative on how to exercise your privacy rights. However, we will need to take steps to verify that you or your representative are authorized to make the request. For residents of California, we share your personal information for our business purposes as described above. If you require more specific information, please contact us.

Resolving disputes

We hope that we can resolve any disputes about our data protection practices by working with you to understand your concerns and correct any issues. If something is not right or if you have questions about our data protection practices, please contact us. We want to help. You can do so by contacting goadgo or you can also send a physical letter to goadgo. In case you have a dispute regarding your contract with us, please refer to the contract for how these disputes will be resolved. For our Influencers, most disputes will be resolved according to the terms of the Influencer Membership Agreement. In the event of a dispute regarding our data protection practices, we offer several different options, all of which are available to you free of charge. goadgo is committed to cooperating with appropriate European Data Protection Authorities (DPAs), as well as the Swiss Federal Data Protection and Information Commissioner and the Office of the Information Commissioner in the United Kingdom, and to comply with any recommendations made by them, where applicable, regarding personal data transferred from the European Union, Switzerland, and the United Kingdom. In addition, you may have the right to lodge a complaint with your local data protection or privacy authority or supervisory authority. Before making your complaint, we kindly ask that you contact us and allow us to attemp to resolve your issue. goadgo is subject to the investigatory and enforcement powers of the US Federal Trade Commission.

Changes to our Privacy Notice

goadgo may change this Privacy Notice from time to time for various reasons, including to comply with new laws and regulations, to encompass new features and functionalities, and to increase transparency. If we do so, the most current version will always be available at https://goadgo.app. These changes may be minor, such as correcting a typographical error, or they may be changes that affect your rights. If we make a significant change that affects your rights, we will provide you 30 days' notice of those changes by sending you an email through the address in your account or by posting a notice on the App.

Because we are a global company, we may provide translations of this Privacy Notice into languages other than English. If we do so, these translations are provided for your convenience. In the event of any ambiguity or conflict between the translations, the English version shall prevail to the extent permitted by local law.

Please see the sections above for more information about our purposes for processing personal information. goadgo will not process personal information other than for the purposes set out in this Privacy Notice, unless otherwise authorized by the individual. When we transfer personal information we receive under the EU-US DPF to third parties, we will ensure that those third parties have a written agreement with us that requires them to provide at least the level of protection required by the EU -US DPF. Regardless, we may assume legal responsibility for the personal information we transfer in certain circumstances.
